Welcome to Odyssey Home Inspection. These Terms of Service (“Terms”) govern your access to and use of the website https://odysseyhomeinspection.com/ (the “Site”) and any communications you have with Odyssey Home Inspection (“Odyssey Home Inspection,” “we,” “us,” or “our”) through the Site.

By accessing or using the Site, submitting a form, or opting in to our SMS messaging program, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Our Services

Odyssey Home Inspection provides certified home inspection services in the Greater Sacramento area and Northern California, including residential, commercial, multi-family, mobile home, new construction, roof, termite, foundation/structural, pre-purchase and listing inspections, and realtor concierge coordination.

The Site is provided for informational purposes and to allow you to request quotes and schedule inspections. Inspection services themselves are governed by a separate written inspection agreement provided before or at the time of the inspection. In the event of any conflict between these Terms and a signed inspection agreement, the inspection agreement controls with respect to the inspection services.

2. Scheduling, Quotes, and Appointments

Submitting a quote request or scheduling form through the Site does not by itself create a confirmed appointment. We will contact you to confirm availability, pricing, and appointment details. Quotes are based on the property information you provide (such as size, age, and scope) and may be adjusted if that information is inaccurate or incomplete. We use flat-rate pricing quoted up front.

You agree to provide accurate, current, and complete information when submitting forms on the Site.

3. SMS Text Messaging Terms

By checking the SMS consent checkbox on our forms and submitting your information, you provide express written consent to receive SMS text messages from Odyssey Home Inspection at the phone number you provide. These messages may include appointment confirmations and scheduling, report-ready notifications, follow-up communications, realtor and concierge coordination, and occasional service reminders.

  • Message frequency: Varies; typically 1 to 4 messages per month.
  • Cost: Message and data rates may apply, depending on your mobile carrier plan.
  • Opt out: Reply STOP to any message to cancel at any time. You will receive one final confirmation message.
  • Help: Reply HELP to any message, call (916) 906-3770, or email tyler@odysseyhomeinspection.com.
  • Consent not required: Consent to receive SMS messages is not a condition of purchasing any goods or services.
  • Privacy: Your mobile number and opt-in consent are not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.
  • Carriers: Mobile carriers are not liable for delayed or undelivered messages.

4. Informational Content Disclaimer

Content on the Site — including service descriptions, FAQs, blog posts, and general guidance about home systems and the inspection process — is provided for general informational purposes only. It does not constitute professional advice for any specific property, and it is not a substitute for an actual inspection, an inspection report, or advice from qualified professionals (such as contractors, engineers, attorneys, or lenders) regarding your specific situation.

An inspection is a visual examination of the readily accessible systems and components of a property at the time of the inspection. The scope, limitations, and exclusions of any inspection are defined in the written inspection agreement and applicable standards of practice.

5. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or fraudulent information through our forms
  • Attempt to interfere with the operation or security of the Site
  • Copy, scrape, or harvest content or data from the Site for commercial purposes without our written permission
  • Impersonate any person or entity in your communications with us

6. Intellectual Property

The Site and its content — including text, graphics, logos, images, and design — are owned by or licensed to Odyssey Home Inspection and are protected by copyright, trademark, and other intellectual property laws. You may view and print Site content for your personal, non-commercial use. Any other use requires our prior written permission.

7. Third-Party Links and Services

The Site may contain links to third-party websites or services (such as social media or review platforms). We do not control and are not responsible for the content, policies, or practices of third-party sites. Accessing them is at your own risk.

8. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. THIS SECTION APPLIES TO THE SITE AND DOES NOT LIMIT ANY WARRANTIES OR OBLIGATIONS SET FORTH IN A SIGNED INSPECTION AGREEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ODYSSEY HOME INSPECTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. LIABILITY RELATING TO INSPECTION SERVICES IS GOVERNED BY THE APPLICABLE WRITTEN INSPECTION AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless Odyssey Home Inspection and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of these Terms or your use of the Site shall be resolved in the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
